X37} Section 78.103 of the Uniform Fire Cade is amended to read: <br />Section 78.103 - Fireworks - Liabilit Insurance. Persons apply- <br />ing for permits pursuant to,section 7S.10~~a} shall supply the Fire Preven- <br />t~ on Bureau w~ th proof of 1 ~ ab~ 1 i ty insurance or other farm of indemnity i n <br />an amount not less than $500,000 conditioned far payment of all damages which <br />may be caused either to a person or property by reason of the authari zed <br />display or sale and arising from any acts of the applicant, his or her agents, <br />employees or subcontractors. <br />X38} Section 78.105 of the Uniform Fire Cade is amended to read: <br />Section 78.105 -Manufacture Prohibited. The manufacture of fire- <br />works within the jurisdiction of the city is prohibited. <br />X39} 5ectivn 18.106 of the Uniform Fire Code is amended to read: <br />Secti an 18. _,,,,,_,_ ' , ,e i zure . <br />~ rewor s 5,,,,,._ - <br />~a} The chief may seize and remove, ar.~ cause to be seized <br />and removed, at the expense of the owner, all stocks of fireworks <br />svl d, offered or exposed for sale, stared, possessed, or held i n <br />violation of this article. <br />~ b} The chief may destroy fireworks when i t has been deter- <br />mi ned that destruction i s necessary for the preservation of publ i c <br />safety or health. <br />X40} Section 18.101 of the Uniform Fire Code is added to read: <br />Section 78.107 - Stands and Retail Dis la s. A person may engage <br />in retail sales of fireworks from an approved outdoor stand ar from an <br />approved indoor retail sale display. <br />~a} A raved Dutdoor Stands. Such stands shat l be ] ocated a <br />minimum of ten feet from combustible buildings, combustible bui]d- <br />ing wall openings in non-combustible buildings, and spaces where <br />vehicles are allowed to park. The location, arrangement and <br />operation of the stand shall be in compliance with all rules and <br />regulations adopted by the chief, <br />~~b} A roved Indoor Retail Sale Dis la s. Approved indoor <br />retail sale displays shall not be located in a manner such that <br />during,a fire emergency, they would hinder and/ar block any exit, <br />~ ncl ud ~ ng a requ ~ red checkstand exit . Flammable and combust i bl e <br />liquids shall be kept in sealed, tight containers at least 24 feet <br />from fireworks display and sale areas. Individuals responsib]e far <br />retail sales shall regularly monitor and oversee operations to en- <br />sure that the fireworks display, sales and storage areas are order- <br />ly and maintained. Fire extinguishers shall be provided in numbers <br />and locations throughout the retail sales site as required by NFPA <br />Standard 10. Indoor sales shall not be permitted i n al cohol i c <br />drinking establishments, single ar multi-family residential struc- <br />tures or motorhomes. The location, arrangement, and operation of <br />the approved indoor retai 1 sale display shat 1 be i n compliance with <br />all rules and regulations adopted by the chief . <br />X41} Section 19.103 of the Uniform Fire Code is amended to read: <br />Section 19.103. Pl an A royal Above Ground Tanks . Tank instal 1 a- <br />tions far the storage of flammable or combustible liquids above ground in <br />special enclosures ar approved vaults ~ n excess of 1, 000 gallons require prior <br />plan approval by the chief. Applications for such plan approval shall be made <br />in accordance with the administrative code, and shall be accompanied by two <br />copies of the construction plans, ~ ncl udi ng a plot plan shawi ng the 1 ocati on <br />of any buildings or structures, and/or tanks, with relationship to the pre- <br />ordinance - 9 <br />
