~3} The notice shall be given at least 15 days before the revoca- <br />tion becomes effective. If the violation ends within the 15 days, the city <br />may discontinue the revocation proceedings. <br />~4} -~ person whose application far any business license has been <br />denied or whose license has been revoked may, after 9D days f ram the date of <br />denial or revocation, apply for a license upon payment of the application <br />fee and submission of an application form and required attachments. <br />~5} A person whose application for any business license has been <br />denied or whose license has been revoked fora total of two times within one <br />year or who has a total of four denials or revacatians, shall be disquali- <br />fied from applying for a license fora period of two years from the date of <br />the last revocation or denial. <br />Business Licenses Su <br />-_ __ _~ -, ,...,.,,,,~mmary ,S,uspension. <br />~1} Upon determining that a licensed^activity or device presents <br />an immediate danger to person or property, the city may summarily suspend <br />the license for the activity or device, <br />~2} The suspension takes effect immediately upon notice of the <br />suspension being received by the licensee, or being delivered to the <br />licensee's business address as stated on the licensee's application for the <br />license being suspended. Such a notice shall state the reasan far the sus- <br />pensi on ar~d i nfarm the 1 i censee of the provisions for appeal under section <br />3.050, <br />~3} The city may continue a suspension as long as the reasan for <br />the suspension exists or until a determination on appeal regarding the sus- <br />pension is made under section 3.Q5~, <br />3.054 Business Licenses - A eal, <br />~1} An applicant whose application for a license has been denied, <br />ar a licensee whose license has been denied renewal, has been suspended, or <br />is to be revoked, may, within 15 days after the date of notice of the denial, <br />suspension or revocation, appeal in writing to the city. The appeal shall <br />state: <br />~a} The name and address of the appellant; <br />fib} The nature of the determination being appealed; <br />~c} The reason the determination is incorrect; and <br />~d} What the correct determination of the appeal should be. <br />An appellant who fails to file such a statement within the time permitted <br />waives his/her objections, and his/her appeal shall be dismissed. <br />~2} If a notice of revocation is appealed, the revocation does <br />not take effect until final determinatian of the appeal. <br />~3} Unless the appellant and the city agree to a longer period, <br />an appeal shall be heard by a hearings officer within 15 days of the receipt <br />of the notice of intent to appeal. At least 10 days prior to the hearing, <br />the city shall mai 1 nvti ce of the time and 1 ocati on thereof to the appel 1 ant. <br />~4} The hearings officer shall hear and determine the appeal on <br />the basis of the appellant's written statement and any additional evidence <br />he/she deems appropriate, At the hearing the appellant may present testi- <br />mony and oral argument personally or by counsel. The rules of evidence as <br />used by courts of law do not apply. <br />t5} If the appeal is from a denial, the applicant shall carry the <br />burden of proving that he/she is entitled to the license and wherein the <br />Ordinance - 21 <br />
