~3~ Each customer shall be notified, at least annually in con~unc- <br />tion with a regular bill, of the rate and allocation of revenue approved by <br />the budget process for the sewer user charges. <br />Section 3. Section 7.423 of the Eugene Code, X971, is amended to read <br />and provide: <br />7.023 Char es - adjustments. <br />~1} Upon forms provided, or acceptable customer data, any user <br />paying more than the minimum monthly charge established in section 7.020 may <br />apply to the city manager or his/her designee to reduce the monthly charge. <br />No charge shall be reduced below the minimum set in section 7.D20. <br />~2~ The monthly sanitary sewer user rates and charges may be re- <br />duced based on: <br />~a~ The amount of water consumed and not discharged into the <br />sanitary sewer system, or <br />(b} Customer provided information indicating improper re- <br />s gional general customer classification. This information must in- <br />clude BOQ and SS test data from a qualified wastewater testing <br />1 aboratory and/or tests samples by the city or regi anal sewerage <br />agency, that adequately represent their BOD and SS wastewater char- <br />acteri sti cs . <br />~3~ Except for monthly storm sewer service charges for single <br />family and duplex dwellings, which may not be reduced, the monthly storm <br />sewer charge may be reduced; <br />~a~ If a significant portion of the meter size ~50~ or more <br />is designated for fire flow; <br />(b} If the water user can demonstrate the user is paying a <br />disproportionate share of the storm drainage costs. <br />~4~ The city manager or the manager's designee shall investigate <br />the application and certify to the Eugene Water & Electric Board a reduction, <br />if any, in the applicant's monthly sanitary or storm sewer user charges and <br />the conditions and duration of the reduction. If it is determined that the <br />applicant has paid excessive charges resulting from conditions beyond the <br />applicant's control, a credit for the excess paid during all or part of the <br />12 montha preceding the application may also be allowed, The full cost of <br />investigating the application authorized by this section and any conditions <br />required by the city manager or the manager's designee shall be borne by the <br />applicant. The city manager's decision regarding an application shall be <br />final . <br />Section 4. Section 7.D25 of the Eugene Code, ~97~, is amended to read <br />and provide <br />7.025 Char es - Collection and Payment. The Eugene Water & Electric <br />Board is directed to collect the rates and charges provided for in <br />this chapter from each water user. Charges levied in section 7.020 shall be <br />determined by the city manager or his/her designee and certified to the <br />ordinance - 5 <br />
