Section 7.034 of the Eugene Code, 1971, is amended to read <br />and provide: <br />7.030 Char es - Sewer Users Not Served by Eu ene Water & Electric Board. <br />Water users not served by the Eugene Water & Electric Board shall <br />install and maintain meters approved by the city manager or his/her designee <br />which accurately reflect the gallons of water consumed or which pass into <br />the sanitary sewerage system. The meter shall be conveniently available to <br />be read by the city. <br />Section 6. Section 7.035 of the Eugene Cade, 1971, is amended to read <br />and provide; <br />7. D35 Charges - Deli nque,n,ci es. The Eugene Water & Electric Board shal l <br />enforce the collection of rates and charges for sanitary and storm <br />sewer services and may do so by withholding delivery of water, steam or <br />electricity to any premises for which the sanitary ar storm sewer users <br />charges are delinquent, or by any other means of collection provided by the <br />laws of the state or permitted by the charter and ordinances of the city in- <br />cluding certification of delinquencies to the tax assessor of Lane County for <br />collection in the manner provided by ORS 454.25. Rates and charges far sani- <br />tary and storm sewer services shall be collected monthly and if not paid on <br />or before 14 days from and after the date the same shall be payable, the <br />rates and charges shall be deemed to be delinquent. Any charge due which <br />shall not be paid when due may be recovered in an action at law by the city. <br />Section ~. Section 7.044 of the Eugene Code, 1971, is amended to read <br />and provide; <br />7.044 Charles - Penalty for Nonpayment. In the event it becomes neces- <br />sary to certify the sani~~tary or storm sewer user fees and charges <br />established because of nonpayment, there shall be added to the fees and <br />charges a penalty in the amount of 10 percent and the total amount due shall <br />bear interest at the rate established in section 2.OZ2 of this Code from the <br />date of the delinquency. <br />Section B.
