Sectian 5. Section 7.034 of the Eugene Code, 1971, is amended to read and provide: 7.030 Char es - Sewer Users Not Served by Eu ene Water & Electric Board. Water users not served by the Eugene Water & Electric Board shall install and maintain meters approved by the city manager or his/her designee which accurately reflect the gallons of water consumed or which pass into the sanitary sewerage system. The meter shall be conveniently available to be read by the city. Section 6. Section 7.035 of the Eugene Cade, 1971, is amended to read and provide; 7. D35 Charges - Deli nque,n,ci es. The Eugene Water & Electric Board shal l enforce the collection of rates and charges for sanitary and storm sewer services and may do so by withholding delivery of water, steam or electricity to any premises for which the sanitary ar storm sewer users charges are delinquent, or by any other means of collection provided by the laws of the state or permitted by the charter and ordinances of the city in- cluding certification of delinquencies to the tax assessor of Lane County for collection in the manner provided by ORS 454.25. Rates and charges far sani- tary and storm sewer services shall be collected monthly and if not paid on or before 14 days from and after the date the same shall be payable, the rates and charges shall be deemed to be delinquent. Any charge due which shall not be paid when due may be recovered in an action at law by the city. Section ~. Section 7.044 of the Eugene Code, 1971, is amended to read and provide; 7.044 Charles - Penalty for Nonpayment. In the event it becomes neces- sary to certify the sani~~tary or storm sewer user fees and charges established because of nonpayment, there shall be added to the fees and charges a penalty in the amount of 10 percent and the total amount due shall bear interest at the rate established in section 2.OZ2 of this Code from the date of the delinquency.
