<br />ATTACHMENT B <br /> <br />Response to Comments and Questions from <br />December 12, 2005 Public Hearing <br /> <br /> <br />Public Hearing Testimony: <br /> <br />1.Roxie Cuellar, Home Builders Association of Lane County/ Home Builders <br /> <br />Construction Company, testimony (December 12, 2005) states that the Home <br />Builders do not support the PROS Plan. The project list and accompanying <br />maps have been removed from the PROS Plan. This enables staff to promote <br />a legal fiction that because it’s only a plan, it will have no impact on the <br />buildable lands inventory. With the acquisition of 1,600 acres of additional <br />park land, there will be an impact on the inventory. <br /> <br />Staff Response: An earlier draft of the PROS Plan included a detailed project list. <br />That project list was (and is) intended to comply with state statutory system <br />development charge (SDC) requirements set forth at ORS 223.304 and ORS <br />223.209. In order to preserve the necessary flexibility of the project list, the list <br />was separated from the PROS Comprehensive Plan and will be presented to the <br />City Council for adoption as part of the PROS Project and Priority Plan. <br /> <br />The PROS Projects and Priority Plan identifies projects and suggested priorities, <br />and is based on input from thousands of Eugene residents. By nature, the PROS <br />Projects and Priority Plan needs to be flexible to allow the City Council to <br />address shifting priorities and so that the City Council can respond to funding <br />opportunities, and changing community trends and needs. <br /> <br />To ensure that the Project and Priority Plan is reflective of the community input <br />which was collected over the last several years, there will be a public hearing <br />associated with the Council action to adopt the Project and Priority Plan by <br />Resolution. This public hearing is scheduled for March 13, 2006. <br /> <br />Amendments to the PROS Project and Priority Plan will be made by Council <br />Resolution. Whether or not a public hearing is held on a proposed amendment <br />will be a Council decision. The project list will be required to be updated each <br />time the SDC methodology is updated. This process includes public hearings <br />and occurs approximately every five years. Another opportunity for amending <br />the project list may occur with the annual budget process.
