~d~ The delay of the City in applying net operating <br />revenues to the reduction or extinguishment of the original <br />assessments; <br />fey The assets accumulated in the 10th and Oak Overpack <br />Fund ~ No . 5 21 ~ ; <br />~ f } The objections to the proposed assessment adjustments <br />heard by the Council; <br />tg~ The City's desire to complete an equitable, fair <br />and just distribution of these accumulated assets; <br />~h~ The objectors' position and the public expense in <br />pursuing the special proceedings in the Circuit Court of the <br />State of Oregon f or the County of Lane entitled "In the <br />Matter of City of Eugene, a Municipal Corporation, Petitioner <br />vs. Ebella Corporation, et al, objectors",Case No . 1~-84-~64G~, <br />and the willingness of the objectors to withdraw from the <br />court proceedings and allow entry of a default judgment <br />based on settlement agreements in the matter subject to the <br />approval of the Circuit Court; <br />the adjustments herein enacted are fair, just and equitable. ._ .. <br />7. The City Finance Officer on the 5th day of November, <br />1985 filed with the City Recorder the proposed adjustments to the <br />original assessments and posted notice thereof on the bulletin <br />board at City Hall. Further, the notice was published in f our <br />successive publications of the Register Guard, a newspaper of <br />general circulation within the City of Eugene on the following <br />dates: November 5, 6, 7 and 8, 1985, and individual notices were <br />sent by certified mail to the owners of the previously assessed <br />3 -- Ordinance <br />
