made within two ~~} working days of commencement of <br />work. <br />Permittee shall apply for approval to close any storage, use or <br />handling facility at least thirty X30} days prier to the termina- <br />tion of the storage, use or handling of hazardous materials. <br />Such application shall include any change or alteration of the <br />facility closure plan filed pursuant tv Section 50.107 of this <br />Article. This thirty X30} day period may be waived by the chief <br />if there are special circumstances requiring such waiver. <br />fib} Postn~Peārmits. All hazardous materials permits shall <br />be posted in a conspicuous location vn the premises or shall be <br />kept on the premises designated therein. Permits shall at all <br />times be subject to inspection by an officer of the department of <br />public safety or other authorized persons. <br />~c} Hazardous Materials Mana ement Plan. Each applicant far <br />a permit pursuant to this Article shall provide, upon request, all <br />information necessary, ~n accordance with Appendix II-E, for the <br />compilation of a Hazardous Materials Management Plan ~HMMP}. Each <br />applicant shall also provide, if applicable, a copy of an Emergency <br />Response Plan which meets the requirements of 29 CFR 1910.10, and <br />documentation that a Hazard Communication Program, in compliance <br />with ~9 CFR 1910.1200, has been implemented. <br />~d} Hazardous Materials Inventor Statement. Each applicant <br />fora permit pursuant to this Article shall provide, upon request, <br />all ~nformat~on necessary to prepare a Hazardous Materials Inven- <br />tory Statement ~HMIS} in accordance with Appendix II-E. <br />Section 80.144 - Hazardous Materials, General Re uirements. <br />~a} General. The storage, dispensing, use and handling of <br />hazardous materials shall be in compliance with the previsions of <br />this Article. <br />fib} Release of Hazardous Materials. Hazardous materials <br />shat 1 not be released into any sewer, storm drain, ditch, drainage <br />canal , 1 ake, river or tidal waterway, or upon the ground, sidewalk, <br />street, highway or into the atmosphere. <br />EXCEPTIONS: <br />1. Materials intended for use in weed abatement, <br />erosion control, soil amendment or similar applications <br />when applied in accordance with the manufacturer's <br />instructions or nationally recognized practices. <br />z. Materials released in accordance with federal, <br />state or local governing regulations or permits of the <br />Lane Regional Air Pollution Authority ~LRAPA}, with a National <br />Pollutant Discharge Elimination System Permit, with waste <br />discharge requirements established by the Oregon Department <br />of Environmental Quality ~DEQ}, ar with the sewer pretreatment <br />requirements of the Industrial Monitoring Section of the <br />Eugene Public forks Department's wastewater Division. <br />~c} Unauthorized Dischar e. <br />1. Accurate records shall be kept of the unauthorized <br />discharge of hazardous materials. <br />2. The chief shall be immediately notified when an <br />unauthorized discharge becomes reportable under state, <br />federal, or local regulations. <br />Ordinance - ~~ <br />
