Provisions shall be made far controlling and miti- <br />gating unauthorized discharges. <br />4, f~henever any unauthorized discharge due to primary <br />container failure ~s discovered, the involved primary con- <br />tainer shall be repaired or removed from service. <br />5. .Any person, firm or corporation responsible far any <br />unauthorized discharge shall institute and complete all <br />actions necessary tv remedy the effects of such unauthorized <br />discharge, whether sudden or gradual, at no cost to the juris- <br />diction, when deemed necessary by the chief, clean-up shall <br />be,initiated,by the department of public safety ar by an auth- <br />or~zed ~ndiv~dua1 or firm. All costs associated with such <br />clean-up shall be borne by the owner, operator or other person <br />responsible for the unauthorized discharge. <br />~d~ Material Safet Data Sheets. Material safety data sheets <br />~MSDS~ shall be readily available an the premises for all hazardous <br />materials regulated by this article. <br />,~e~ Identification. visible hazard identification signs as <br />spec? f ~ ed ~ n U.F.C. Standard 19-3 shal l be placed at al l entrances <br />to 1 ocati ans where hazardous materials are stored, dispensed, used <br />or`handled in quantities requiring a permit. The chief may waive <br />this requirement ~n special cases when consistent with safety. <br />Individual containers, cartons or packages shall be conspicuously <br />marked or labeled in accordance with nationally recognized stand- <br />ards. See also Section 80.301~d~.~ <br />Section 80.105 - Hazardous Materials Construction Re uirements. <br />Buildings or portions thereof in which hazardous materials are stored, <br />handled or used shall be constructed in accordance with the Structural Spe- <br />cialty Code adapted by Section 8.010 of the Eugene Code, 1971. Boundaries <br />of a control area shall be formed by one or mere of the following: <br />1. An occupancy separation with a minimum one-hour fire- <br />resistive rating. <br />2. The exterior wall, roof or foundation of the building. <br />A maximum of four control areas shall be permitted within a buildin . <br />9 <br />EXCEPTION: A maximum of two control areas shall be <br />permitted in buildings or portions of buildings used for <br />retail sales. <br />Section 80.106 -Hazardous Materials, Personnel Trainin and <br />written Procedures. Persons responsible for the operation of areas in which <br />hazardous materials are stored, dispensed, handled or used shall be familiar <br />with the chemical nature of the materials and the appropriate mitigating <br />actions necessary in the event of fire, leak or spill. Responsible persons <br />shall be designated and trained to be liason personnel far the department of <br />public safety. Persons designated to, or reasonably expected to, respond <br />to on-site emergencies involving hazardous materials shall receive training <br />in accordance with 29 CFR 1910.120 if the involved facility is subject to <br />regulation under this OSHA code. These persons shall aid the department of <br />public safety in pre-planning emergency responses, identification of the <br />locations where hazardous materials are located, shall have access to <br />Material Safety Data Sheets and be knowledgeable in the site emergency res- <br />ponse procedures. <br />Section 80.107 - Hazardous Materials Facilit Closure Plan.
