CityofSpringfieldstaffandcalculationsofsupplyanddemandfromtheMetropolitanIndustrial <br />LandsInventoryReport,1993.TheState-acknowledgedMetropolitanIndustrialLands <br />InventoryReportincludedasurplusofindustrialacreageof2,954.28acres(consideringalow <br />demandassumption)orof2,432.28acres(consideringahighdemandassumption).Thisacreage <br />representsthoselandsthatweredesignatedasindustriallands,beyondtheacreageneededto <br />accommodatetheprojected20-yeardemand.SincetheadoptionofthatReport,Eugeneand <br />Springfieldhavetakenvariousactionsthathavehadanetdecreaseintheamountofsurplus <br />industrialacreage,resultinginacurrentsurplusofeither2,048.37acres(consideringalow <br />demandassumption)orof1,526.37acres(consideringahighdemandassumption).The/WQ <br />regulationswillimpact14.28acresofindustrialbuildablelandwithinthecitylimits,leavinga <br />surplusof2,034.09acres(consideringalowdemand)and1,512.09acres(consideringahigh <br />demand).OutsidethecitylimitsandwithintheUGB,/WQregulationswillaffect12.89 <br />industrialacresforatotalimpactof27.17acreswhenaddedtoimpactacreswithinthecity <br />limits.Total/WQimpactacres,withinandoutsidethecitylimitsandwithintheUGB,willleave <br />anetsurplussupplyof2,021.20acres(consideringalowdemand)and1,499.20acres <br />(consideringahighdemand).Therefore,eveniftheprovisionsdescribedin1.4.,above,were <br />notincludedintheordinance,the/WQregulationscontainedinthisordinance,oranordinance <br />applying/WQtoacresoutsidethecitylimitsandwithintheUGB,donotunlawfullydiminish <br />thesupplyofindustrialland. <br />Basedontheforgoingdiscussionandanalysis,itisclearthatevenifthemaximumpossiblearea <br />withintheproposed/WQmanagementareawastreatedasasubtractionfromthebuildablelands <br />inventory,andtakingintoaccountplanamendmentsthattooklandoutofcommercialand <br />industrialcategories,andtakingintoaccountlegislativezonechanges,therewouldstillbeanet <br />1 <br />surplusofbuildablelandsintheapplicablecategoriesforbothindustrialandcommercialland. <br />Therefore,theordinanceisconsistentwithGoal9. <br />Goal10-Housing:Toprovideforthehousingneedsofthecitizensofthestate. <br />The/WQoverlayzonedoesnotrenderapropertyunusableforresidentialuses.Infact,specific <br />provisionsinthe/WQoverlayzoneensurethattheoverlayzonedoesnothavesuchaneffecton <br />aproperty.Someofthoseprovisionsare: <br />1.Theuserestrictionsofthe/WQoverlayzoneonlyapplytothatportionofalot,orright-of- <br />wayarea,thatiswithinthechannelofanidentified/WQwaterwayandthespecifiedsetback <br />distancefromthewaterwaybasedontheassociatedsetbackmeasurementpoint.Theuse- <br />restrictedareaisreferredtoasthe/WQsetbackmanagementarea.Withintheportionsofthe <br />lotthatareoutsideofthe/WQmanagementarea,landusesarenotrestrictedbythe/WQoverlay <br />zone.EC9.4780(1).Propertiesthathaveabasezoninganddesignationallowingcommercialor <br />1 <br />TheCitysadoptionofthe/WQregulationsdonotimpactlandoutsideoftheCitylimits.IfLaneCountychooses <br />toadoptsimilarprovisions,itwillassessitsimpactatthattime.Thelandidentifiedtoreceivethe/WQoverlayzone <br />uponannexationincludesnocommercialbuildablelandand12.89acresofindustrialbuildableland.However,itis <br />notclearwhen,ifevertheseparcelswillbeannexedor,whether,whentheydoannex,theywillqualifyforan <br />exemptionundertheordinance.Eveniftheseparcelsareconsideredasdebitstotheexistingsurplus,theordinance <br />isconsistentwithGoal9. <br />UpdatedDraftLegislativeFindings-forCouncilMeetingMarch9,2009 <br />Page6of17 <br />
