industrialusescanstillbedevelopedwithsuchusesonthoseportionsofthelotthatarenot <br />withinthe/WQmanagementarea. <br />2.Iftheregulatedareaoccupiesmorethan33%ofadevelopmentsitearea,uponapplicationof <br />thepropertyowner,andconsistentwiththeothercriteriaofEC9.8030(25)(a),theCitywill <br />reducethesizeofthe/WQconservationareatoensurethattheareaconstitutesnomorethan <br />33%ofthedevelopmentsitearea. <br />3.Uponapplicationoftheownerofalotwiththe/WQoverlaythatshowsconsistencywiththe <br />criteriaofEC9.8030(25)(b),thecitywillreducethesizeofthesetbackdistance. <br />4.Uponapplicationoftheownerofalotwiththe/WQoverlaythatshowsconsistencywiththe <br />criteriaofEC9.8030(25)(c),thecitywillallowusesnototherwiseidentifiedintheordinance,or <br />approveadifferentmeansofprotectingwaterqualitytoallowaproposeddevelopmentthat <br />wouldnotbepermissibleunderthestrictapplicationoftheordinance. <br />Consideringtheseprovisionsofthe/WQoverlayzone,theapplicationoftheoverlayzonetoa <br />propertyzonedanddesignatedforresidentialusedoesnotresultinanunlawfuldiminutioninthe <br />areassupplyofresidentialland. <br />Evensupposingtheprovisionsabovewerenotapartoftheoverlaysregulations,theoverlayis <br />beingappliedtosuchasmallnumberofacresincludedintheareasinventoryofresidential <br />landsthatthisordinanceoverlaycouldnotdepletetheareassupplyofthoselandsbelowthe <br />projectedneed. <br />AnanalysisofpotentialimpactstothesupplyofbuildableresidentiallandswithintheEugene <br />UGBwasconductedusingtheregionalGeographicInformationSystem(GIS),dataprovidedby <br />CityofSpringfieldstaffandcalculationsofsupplyanddemandfromtheSupplyandDemand <br />TechnicalAnalysisoftheEugene-SpringfieldMetropolitanAreaResidentialLandsand <br />HousingStudy(RLHS),1999.TheState-acknowledgedEugene-SpringfieldMetropolitanArea <br />ResidentialLandsandHousingStudyincludedasurplusofresidentialacreageof1,862acres <br />(consideringalowdemandassumption)orof790acres(consideringahighdemandassumption). <br />Thisacreagerepresentsthoselandsthatweredesignatedasresidentiallands,beyondtheacreage <br />neededtoaccommodatetheprojected20-yeardemand.SincetheadoptionofthatStudy,Eugene <br />andSpringfieldhavetakenvariousactionsthathavehadanetdecreaseintheamountofsurplus <br />residentialacreage,resultinginacurrentsurplusofeither1,250.33acres(consideringalow <br />demandassumption)orof178.33acres(consideringahighdemandassumption).Evenifthe <br />provisionsdescribedabovewerenotincludedintheordinance,the/WQregulationscontainedin <br />thisordinancecouldaffect,atmost,45.75acresofresidentiallydesignatedlandwithinthecity <br />limits,leavingasurplusof1,204.58acres(consideringalowdemandassumption)orof132.58 <br />acres(consideringahighdemandassumption). <br />OutsidethecitylimitsandwithintheUGB,/WQregulationswillaffect25.99residentially <br />designatedlandacresforatotalimpactof71.74acreswhenaddedtoimpactacreswithinthecity <br />limits.Total/WQimpactacres,withinandoutsidethecitylimits,willleaveanetsurplussupply <br />of1,178.59acres(consideringalowdemand)and106.59acres(consideringahighdemand). <br />UpdatedDraftLegislativeFindings-forCouncilMeetingMarch9,2009 <br />Page7of17 <br />
