/9i9~ <br />~2} The application shall be accompanied by a fee set by the <br />council. <br />. ~3} At.ieast ten days before the hearing, the planning department <br />shat] mail a nat~ce thereof and information an the nature of the request to <br />the applicant, owners and occupants of the subject property, abutting pro - <br />p <br />erty owners and occupants, and to owners and occupants of properties adja- <br />cent to abutting properties. For this notice, properties abutting the area <br />of the zone change proposal include those separated from it by intervenin <br />g <br />streets or alleys. At least ten days prior to the hearing, the planning de- <br />partment shall also post notices of the nature of the request and the hear- <br />ing in at least three places within 344 feet of the subject property, <br />~4} Notice of a proposed change in a zoning district shall be <br />sufficient public notice of change to SR site review} subdistrict of the <br />proposed new district. <br />9.674 Decision and A eal Authority, 1f a zone change is for property <br />proposed for annexation to the city, it shall be approved, modi- <br />f~ed and approved, ar denied by the planning commission. The city council <br />shall act on appeals from planning commission decisions on zone changes in <br />can~unct~on with annexations. If a zone change only includes property al- <br />ready in the city, it shall be approved, modified and approved, or denied by <br />the hearings official, The planning commission shall act an appeals from <br />decisions of the hearings official. commission decisions are final. All <br />final zoning district change decisions shall be by order which shall mandate <br />in relevant cases that the zoning map established under section 9.74 of the <br />Eugene Code, 1971 be amended to reflect the allowed change of zoning dis- <br />trict. <br />9.676 Investi anon and Re art, The planning department shall investi- <br />gate the facts bearing upon an application, prepare a report, and <br />submit it to the commission or hearings official for consideration, prior to, <br />or at the pub1~c hearing. A copy of the report shall be mailed or delivered <br />to the applicant at the time it is delivered to the commission or hearings <br />official. <br />9.678 Public Hearin <br />~1} Unless the applicant agrees to a longer time period, within <br />45 days of receipt of a complete and accurate application, the commission ar <br />hearings official shall hold a public hearing to consider the proposed <br />change in zoning district boundaries. <br />~Z}. The commission or hearings official shall review the applica- <br />t~on and receive pertinent evidence and testimony as to why or how the pro- <br />posed change is consistent with the following criteria required far approval: <br />~a} The uses and density that will be allowed in the loca- <br />tion of the proposed change ~1} can be served through the orderly <br />and efficient extension of key urban facilities and services pre- <br />scribed in the Metropolitan Area General Plan, and ~~} are con- <br />sistent with the principles of compact and sequential growth, <br />fib} The proposed change is consistent with the Metropolitan <br />Area General Plan ~1} applicable text, ~2} specific elements re- <br />lated to the uses listed in the proposed zoning districts, and <br />~3} applicable land use designations.
