89'+5 <br />Section 3. Section 4.380 of the Eugene Code, 19?l, is hereby <br />amended to read and provide: <br />4.380 Abandoned Animals. <br />~l} Na person in charge of an animal may abandon the <br />animal, and no owner of an animal may allow it to be abandoned. <br />~~} Any peace officer or dog control officer, upon <br />finding an abandoned animal not impounded by the dog control <br />authority, may: <br />~a} Provide food and water and arrange for needed <br />medical service far the animal at the cost of the owner <br />or person in charge of the animal. The owner or person <br />in charge of the animal shall pay for such services; or, <br />~_b} Impound the animal. As soon as practical, <br />notice of impoundment under this section shall be posted <br />at the house or an the structure where the animal was <br />found or be mailed to the owner or person in charge, of <br />if the owner or person in charge is unknown, to the <br />address at which the animal was found and impounded. <br />Section 4 . The caption, and subsections ~ 2 } and ~ 3 } of Section <br />4.40D of the Eugene Cade, 19'1., are hereby amended to read and pra- <br />vide.: <br />4.400 Impoundin Re ulations and Disposition of Impounded <br />Animals. <br />~ ~ } Except as .provided in section ~ 1 } ~ a } , the dog con- <br />trol authority shall notify the owner by telephone or by the <br />mailing of an impoundment notice as soon as practicable after <br />impoundment. The impoundment notice shall advise the owner of <br />the place where the animal is kept, the procedures required <br />.for the redemption of the animal, the fees for the impoundment, <br />daily care and redemption, and the consequences of failure to <br />redeem the animal. <br />~3} A dog owner whose dog is impounded under sections <br />4.410 and 4.435 of this code, within the time described in sec- <br />tions ~l} ~a} ar ~l} ~.b} , whichever is applicable, believing <br />to have been aggrieved by the seizure and impounding of the <br />dog, may apply to the municipal judge for release of the dog, <br />and the municipal judge shah, thereupon set a time and place <br />for hearing the application and notify the impounding officer, <br />and. upon a summary hearing the municipal judge shall have full <br />power to determine whether the dog has been wrongfully im- <br />pounded, whether it shall be returned to its owner, and upon <br />what terms and whether it should be humanely destroyed and the <br />cost of impoundment, care and destruction assessed to the owner <br />of the dog. <br />Ordinance - ~ <br />
