after notice of the decision is mailed. <br />9.7340 Expiration <br />(1) Approval of a Type III application shall expire 18 months from the effective <br />date of approval except as provided in subsections (2) through (4). If an <br />application approval has expired according to any of the conditions stated in <br />subsections (2) through (4), the original application approval is revoked. <br />(2) Unless the hearings official designates otherwise, a conditional use permit <br />approval shall expire 18 months after the effective date of approval unless actual <br />construction or alteration has begun under a required permit, or in the case of a <br />permit not involving construction or alteration, actual commencement of the <br />authorized activity has begun. However, the applicant may submit a <br />modification application at any time before the 18-month period has expired, <br />requesting an extension of the approval period. The applicant may request more <br />than one extension. Under no circumstances, however, can the total combined <br />extension periods exceed 36 months from the original expiration date. <br />(3) A planned unit development tentative plan approval shall expire if the applicant <br />fails to submit a planned unit development final plan application in accordance <br />with the schedule approved at the time of tentative plan consideration. In the <br />absence of a specified schedule, the tentative plan approval shall expire 18 <br />months after the effective date of tentative plan approval. <br />(4) Unless the hearings official designates otherwise, a Willamette Greenway <br />permit approval shall expire 18 months after the effective date of approval <br />unless actual construction or alteration has begun under a required permit, or in <br />the case of a permit not involving construction or alteration, actual <br />commencement of the authorized activity has begun. However, the applicant <br />may submit a modification application at any time before the 18 -month period <br />has expired, requesting an extension of the approval period. The applicant may <br />request more than one extension. Under no circumstances, however, can the <br />total combined extension periods exceed 36 months from the original expiration <br />date. <br />Type IV Application Procedures <br />9.7400 General Overview of Type IV Application Procedures. The Type IV process <br />provides for a quasi-judicial review by the planning commission and city council of <br />applications that involve a specific site. The Type IV process includes public notice <br />and a public hearing. A public hearing is held before the planning commission, which <br />forwards a recommendation to the city council. The city council holds a public <br />hearing before making a final decision. The city council's decision is based on <br />compliance with applicable approval criteria in this land use code.
