(1) At least 20 days before the planning commission public hearing, the city shall <br />mail written notice of the hearing to the: <br />(a) Applicant. <br />(b) Owners of the subject property. <br />(c) Owners and occupants of property located within 500 feet of the perimeter <br />of the subject property. <br />(d) Neighborhood group officially recognized by the city that includes the area <br />of the subject property. <br />(2) Notice of a proposed change in zone concurrent with the annexation shall also <br />be sufficient public notice of a change to, or addition of, any overlay zone. <br />9.7525 Staff Investigation and Report City staff shall investigate the facts bearing on an <br />application and prepare a staff report with a staff recommendation. At least 7 days <br />prior to the public hearing, the staff report shall be submitted to the planning <br />commission and made available to the public upon request. A copy of the report shall <br />be mailed or delivered to the applicant at the time it is delivered to the planning <br />commission. <br />9.7830 c Publi Hearin Conduct Procedures. The pl annin g ' <br />- - - -- -- - _ _ - � t an edur <br />- _ , ,..,_,....,.,,... � P g commission shall conduct <br />a public hearing according to the quasi - judicial hearing procedures in EC 9.7065 <br />Quasi- Judicial Hearings- Procedures. <br />9.7835 Criteria of Approval for Annexations. The planning commission shall review the <br />application and receive pertinent evidence and testimony as to why or how the <br />proposed annexation is consistent with the following criteria: <br />(1) The property is inside the urban growth boundary and annexation would be <br />consistent with adopted plans and policies. <br />(2) Public services and facilities can be provided as prescribed in the Metro Plan or <br />applicable refinement plans. <br />(3) Annexation will result in a boundary in which services can be provided in an <br />orderly, efficient, and timely manner. <br />9.7540 Criteria of Approval for Chances in Zone Concurrent with Annexations. To <br />maintain consistency between zoning and applicable plans and studies, the planning <br />commission may also recommend zone changes for the city council to consider in <br />conjunction with annexation applications. The planning commission shall review the <br />application and receive pertinent evidence and testimony as to why or how the <br />proposed change in zone concurrent with an annexation is consistent with the <br />following criteria: <br />(1) The proposed change is consistent with the Metro Plan. The written text of the <br />Metro Plan shall take precedence over the Metro Plan diagram where apparent <br />conflicts or inconsistencies exist. <br />(2) The proposed zone change is consistent with applicable adopted refinement <br />Ordinance - 321 <br />
