5. TERMS AND DEFINITIONS <br />Alcohol <br />As defined by the FMCSA, the intoxicating agent in beverage <br />alcohol, ethyl alcohol, or other low molecular weight alcohols <br />including methyl or isopropyl alcohol. <br />As defined by the City of Eugene, alcohol means any alcoholic <br />beverage containing more than one half of one percent alcohol <br />by volume, and every liquid or solid, patented or not, containing <br />alcohol, and capable of being consumed by a human being. <br />Alcohol Use <br />The consumption of any beverage, mixture, or preparation, <br />including any medication, containing alcohol. <br />Breath Alcohol Technician <br />An individual who instructs and assists individuals in the alcohol <br />(BAT) <br />testing process and operates an EBT. <br />Chain of Custody <br />Procedures to account for the integrity of each urine specimen <br />by tracking its handling and storage from point of specimen <br />collection to final disposition. These procedures require that a <br />DOT drug testing control and custody form be used at the time <br />of collection to receipt by the laboratory and that upon receipt by <br />the laboratory (an) appropriate chain of custody form(s) <br />accounts for the sample within the laboratory. <br />Controlled Substance <br />As defined by the City of Eugene, controlled substance means <br />any drug or its immediate precursor classified in Schedules I <br />through V under the Federal Controlled Substances Act, 21 USC <br />Sections 811 to 812, as modified under ORS 475.035. The use <br />of the term "precursor" in this subsection does not control and is <br />not controlled by the use of the term "precursor" in ORS <br />475.940, 475.950, and 475.955. In addition, manufactured drugs <br />recognized by health and law enforcement agencies that are not <br />included in Schedules I through V under the Federal Controlled <br />Substances Act, 21 USC Sections 811 to 812, as modified under <br />ORS 475.035 are considered to be controlled substances. <br />Covered Employee <br />Any employee who is employed in a position covered by this <br />policy. Said positions are listed in Part 6 attached hereto. <br />Designated Employer <br />The employer's representative, who is responsible for <br />Representative (DER) <br />administering the employer's DOT and FMCSA drug and <br />alcohol testing program. <br />Department of <br />The U.S. Department of Transportation which oversees the rules <br />Transportation (DOT) <br />regarding the Drug and Alcohol Testing programs of the <br />operating agencies, e.. the FMCSA, etc. <br />City of Eugene Page 5 -1 DOT/FMCSA Drug & Alcohol Policy <br />September 2010 _.
