EC 9.3015 Process for Establishment or Change of an S Special Area Zone states: <br />Establishment of an S Special Area zone shall be processed as a Type V application as provided for in <br />EC 9.7500 through EC 9.7560 Type V Application Procedures, based on the criteria in EC 9.3020 and <br />the required provisions of EC 9.3030. Application of the S Special Area zone to specific areas shall be <br />processed concurrently with establishment of the special area zone. Future application of the zone to <br />specific properties shall be processed as a zone change. <br /> <br />EC 9.7505 Type V Application Requirements and Criteria requires that land use code amendments be <br />reviewed under the Type V application review process. EC 9.7510 City-Initiation of Applications states <br />that the City Council may initiate a Type V application on its own behalf, or in response to a person's <br />written request filed with the Planning Director that the city council initiate a land use code amendment. <br /> <br /> CO[INCIL OPTIONS <br /> The council has the option to: <br /> 1. Initiate the code amendment process; or, <br />2. Decline to initiate the code amendment process. <br /> <br /> CITY MANAGER'S RECOMMENDATION <br />The City Manager recommends that the council initiate the requested code amendment. The council <br />would then have the opportunity through the application process to consider establishing a Special Area <br />zone and consider its merits as applied to the site. <br /> <br /> S[IGGESTED MOTION <br />Move to initiate a code amendment to Chapter 9 of the Eugene Code to consider the establishment of a <br />Special Area Zone for the Johansen-Moody house site at 370 River Road. <br /> <br />ATTACHMENTS <br />A.
