<br />who arrived in Eugene in 1846, was one of the founders of the Eugene Water Company in 1886, and he <br />had the Shelton-McMurphey-Johnson House (303 Willamette St.) built in 1888. Previously, the <br />Shelton-McMurphey-Johnson Board members had recommended McMurphey Way, see attached letter <br />dated November 4,2005. The McMurphey name is related to the Shelton family. The granddaughter of <br />Dr. and Mrs. Shelton, Alberta Shelton was a member of the first graduating class of the University of <br />Oregon, and she married Robert McMurphey. Together they lived in the Shelton-McMurphey-Johnson <br />House. Like Dr. Shelton, Mr. McMurphey was active in civic and commercial affairs having been a <br />board member of the Eugene Water Works Board, City Park Board, and was the first vice president of <br />the Eugene Commercial Club in 1902. He helped organize the Willamette Valley Woolen <br />Manufacturing Company in 1901 and he earned a living in real estate and insurance businesses. <br /> <br />Site Description <br />The proposed street name change affects the entire 3rd/4th Connector between the intersection of West 3rd <br />A venue and Lincoln Street; and the intersection of West 4th Avenue and Pearl Street. The street follows <br />the topography of the flanks of Skinner Butte causing the street to curve from West 3rd Avenue to West <br />4th A venue. The street was recently improved to City standards with paving, curbs, gutters, street trees, <br />and sidewalks and was realigned at its intersections with West 3rd and East 4th Avenues (see attached <br />news release). As shown on attached maps, there are 10 properties that abut the street, but only three <br />properties have 4th Avenue addresses which would need to be changed. Other properties are either <br />vacant or are developed with addresses associated with other abutting streets. Staff notes that one <br />property with a 4th Avenue address is an apartment complex with 56 units (1 West 4th Avenue). <br /> <br />Tvpe IV Street Name Chanee <br />Oregon Revised Statutes (ORS) provides the procedure for renaming streets. ORS 227.120 states that <br />the Planning Commission shall recommend to the City Council whether a street should be renamed, if in <br />the judgment of the commission, such renaming is in the best interest of the City. Consistent with ORS <br />227.120, the Eugene Code requires that Street Name Changes be processed as a Type IV application <br />according to procedures specified in EC 9.7400 to 9.7455. The Planning Commission shall conduct a <br />public hearing according to the quasi-judicial procedures of State law and those set out in Eugene Code <br />9.7065 to 9.7095. The Planning Commission shall make a recommendation to the City Council whether <br />to approve, approve with modifications or deny the street name change application. The <br />recommendation shall be based on the required approval criteria, EC 9.8485 regarding what is in the <br />best interest of the City. <br /> <br />The City Council will also conduct a public hearing according to the same quasi-judicial procedures <br />prior to making a decision. The decision of the City Council is final. A party may appeal the decision <br />to the Oregon Land Use Board of Appeals within 21 days of the decision of the City Council. Appeals <br />to the Oregon Land Use Board of Appeals are governed by ORS 197.805 to 197.860. <br /> <br />Referrals. Staff Report and Public Hearine Notice <br />Oil February 1 O~ 2006, the City mailed notice of the proposed street name change to owners and <br />occupants within 300' of the 3rd/4th Connector, and posted notices and freestanding signs along the street <br />as required by EC 9.7415.
